Toolbox Talk: Guided Choice Mediation

Program Description: When you use mediators earlier in the settlement process, you get settlements that clients perceive as more valuable. Why? Because legal expense is directly related to the time the dispute is pending. Mediators trained in Guided Choice Mediation get earlier settlements by using pre-settlement phase before encouraging settlement discussions. During that phase, the mediator identifies the parties' needs and the obstacles that might lead to impasse and, with the parties' involvement, designs a process specific to the dispute to satisfy those needs. Those needs include not only information exchanges but also human behavior issues and organizational needs. The best mediators do not impose ideas. They create an atmosphere of collaboration so that the parties are engaged and buy into the process.
